Terms of Service

These Terms of Service ("Terms") govern your use of the Yabuu mobile application ("App", "Service") operated by Yabuu ("we", "us", "our"). By downloading or using the App, you agree to be bound by these Terms. If you disagree with any part of these Terms, do not use the App.

Yabuu is a mobile application that enables airplane passengers to communicate and play games with nearby passengers using Bluetooth wireless technology — without requiring an internet connection, Wi-Fi, or cellular data. The App also provides an interactive flight map and the ability to share your flight experience on social media.

You may use Yabuu if you are at least 4 years of age. If you are under 13, you should use the App only with the involvement and consent of a parent or guardian. By using the App, you represent that you meet these requirements.

You agree to use Yabuu only for lawful purposes. You agree not to:

• ▸Send messages that are harassing, abusive, hateful, obscene, or threatening
• ▸Impersonate any person or entity
• ▸Attempt to interfere with, disrupt, or gain unauthorized access to other users' devices
• ▸Use the App in any way that violates applicable laws or airline regulations
• ▸Attempt to reverse engineer, decompile, or extract the source code of the App
• ▸Use the App for commercial solicitation without our written permission

We reserve the right to terminate your access to the Service for violations of these rules, although because no accounts are required, enforcement is primarily handled through App Store policies and device-level controls.

Yabuu requires Bluetooth access to function. By granting Bluetooth permission, you allow the App to discover and connect to nearby devices also running Yabuu. You remain in full control of your Bluetooth settings and may revoke this permission at any time through your device settings.

The App also requests GPS/Location access for the in-flight map feature. Location data is processed entirely on your device and is never transmitted to our servers. You may deny this permission; the map feature will not be available but all other features remain functional.

Messages, drawings, and game moves sent through Yabuu are transmitted peer-to-peer via Bluetooth between devices in the same session. This content is not stored on our servers and is deleted automatically when the session ends.

You are solely responsible for any content you transmit through the App. You represent that your content does not violate the rights of any third party or any applicable law. We have no ability to monitor, and accept no responsibility for, peer-to-peer messages exchanged between users.

The Yabuu name, logo, design, graphics, and all content created by us are our intellectual property and are protected by copyright and trademark laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any portion of the App without our express written permission.

Yabuu is currently free to download and use. If we introduce paid features or in-app purchases in the future, we will update these Terms and provide clear pricing information within the App and on the App Store listing.

All purchases, if any, are processed by Apple through the App Store and are subject to Apple's terms and refund policies.

Yabuu is designed as an entertainment app for use during flights. It is not intended for safety-critical communications. Do not rely on Yabuu for emergency communication.

Always follow the crew's instructions regarding electronic device use. Some airlines require Bluetooth to be disabled during takeoff and landing.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YABUU AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR ANY OTHER LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM (OR €10 IF YOU HAVE NOT PAID ANYTHING).

These Terms are governed by and construed in accordance with the laws of the European Union and the applicable laws of your country of residence, without regard to conflict-of-law provisions.

Any disputes arising under these Terms shall be subject to the jurisdiction of the courts in your country of residence.

We reserve the right to modify these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will provide notice via App Store release notes.

Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, please stop using the App and uninstall it from your device.

We may terminate or suspend your access to the App immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the App ceases immediately.

You may stop using the App at any time by uninstalling it from your device. Uninstalling the App will not affect data already collected.
